The sentence was mitigated because the statements were of a 'domestic nature' and were not a 'compulsory or imposed opinion'

The Southern District Military Court replaced the real sentence with a fine of 2.5 million rubles for serviceman Seferbeg Gadzhiev in the case of spreading military 'fakes', writes 'Kavkaz. Realii'*. The court of first instance sentenced him to 5.5 years in a penal colony. The appeal stripped him of his military rank and released him from the pre-trial detention center.

As stated in the ruling, in September last year Gadzhiev was performing the duties of the shift commander of the military commandant's platoon and the guard commander for the protection of the military unit's warehouse in Rostov-on-Don. Wanting to 'scare' subordinates, he 'exaggerated the enemy's successes in the territory of the DPR' and negatively assessed the actions of the Russian army. The court did not specify the exact words.

In the appeal, Gadzhiev was also found guilty of spreading military 'fakes', but the sentence was mitigated because it was considered that the conversation was of a 'domestic nature', and the interlocutors did not perceive what Gadzhiev said as a 'compulsory or imposed opinion'. In addition, he has awards and donated 10 thousand rubles to a children's aid center, noted the judicial panel.
