Court Overturns Arrest of South Korean President Previously Detained for Attempt to Impose Martial Law

He justified his decision with procedural norms — the legal time limits for filing charges were exceeded

On Friday, the court ordered the release of ousted President Yoon Suk Yeol, granting his request to overturn the arrest related to his brief imposition of martial law, reported the agency Yonhap.

In February, Yoon Suk Yeol filed a petition to overturn the arrest, claiming that the indictment against him was illegal. President Yoon had been in detention since January 15 on charges of inciting rebellion following his imposition of martial law on December 3.

The court justified the decision to overturn the arrest by exceeding the legal time limits for filing charges. The prosecution protested, stating that according to the criminal procedure code, the time should be calculated in days, not minutes and hours, as claimed by Yoon's team.

The court also sided with the president, questioning the legality of the actions of the Office for the Investigation of Corruption among High-Ranking Officials regarding his alleged rebellion, which exceeds the agency's authority.

The main opposition Democratic Party (DP) expressed outrage over the "release of the rebellion leader" and urged the prosecution to immediately file an appeal. DP Chairman Lee Jae Myung also intensified criticism of the decision, stating that a mistake in the prosecution's calculations does not negate the fact that Yoon violated the Constitution.
